PHIPA Consent
For services provided through Careby Solutions Inc.

Careby Solutions Inc. operates as a Privacy Agent under Ontario's
Personal Health Information Protection Act (PHIPA). When you purchase
a service from Careby, you consent to the collection, use, and limited
disclosure of your information as described below for that specific service.
This page lists the specific consent terms for each service we offer. By
ticking the consent box during checkout for any service, you agree to the
terms for that service. You can review our full
Privacy Policy at any time and may withdraw your
consent by contacting hello@getcareby.ca.
1. Health Panels (Body Check)
Applies to: The Essentialist, Longevity Audit, Vitality 60+,
and Careby Infinity panels.
What we collect
- Your name, date of birth, contact information, and household details
- Information needed for the physician to order the panel
- The lab results returned from the panel
- Any clinical notes from Dr. Jerry Leung's review of your results
Who we share it with
- Dr. Jerry Leung, Careby's Medical Director, who orders the panel and reviews your results
- The lab (Dynacare or LifeLabs) that performs the testing
- Careby's coordination team, who schedules your appointments, delivers your results, and helps you understand next steps
How long we keep it
Clinical records are retained by Dr. Leung's clinic in accordance with the
College of Physicians and Surgeons of Ontario's retention requirements (10
years after your last visit, or 10 years past the age of majority for minors).
Your coordination records at Careby are retained for 7 years after account closure.
Your consent: By purchasing a Health Panel, you consent to
Careby coordinating your panel through Dr. Jerry Leung's clinic, to the lab
performing the testing, and to your results being reviewed and discussed with
you by Dr. Leung and the Careby coordination team.
2. Doctor On-Call (Memberships)
Applies to: Careby Standard ($55/month) and Careby Plus ($199/month)
memberships, including all family members covered under your membership.
What we collect
- Your name, date of birth, contact information
- The names and details of household members covered under your membership
- A record of physician appointments coordinated through Careby
- Any notes from the Careby coordinator who assists you
Who we share it with
- Careby's virtual physician partner network, which provides the licensed physicians who conduct your appointments
- Careby's coordination team, who books your appointments and follows up on care plans
Clinical information from your physician appointments (medical history,
diagnoses, prescriptions) is held by the attending physician and the physician
partner network, not by Careby. Careby retains coordination records only —
such as when an appointment was booked and whether you attended.
How long we keep it
Coordination records are retained for the duration of your membership plus 7 years.
Clinical records are retained by the physician network in accordance with their
professional retention requirements.
Your consent: By purchasing a Careby membership, you consent
to Careby coordinating physician services for you and your household, and to
information about your appointments being shared between Careby's coordination
team and the physician network as needed to deliver care.
3. In-Home Care
Applies to: SafeHome monitoring, caregiver services (PSW),
medical accompaniment, and any other in-home services purchased through Careby.
What we collect
- Your name, date of birth, contact information, and home address
- The name and details of the household member receiving care, if different from the purchaser
- Information about the household environment relevant to safe care delivery
- Visit logs, care notes, and (where included) ambient monitoring information from the home
Who we share it with
- The assigned caregiver(s) providing the in-home services
- The home monitoring service provider, where ambient monitoring is included in your service
- Careby's coordination team, who manages your care plan
- Designated family members, only with your prior written authorization, for alerts about care events such as falls or health changes
How long we keep it
In-home care records are retained for 7 years after the service ends, in line
with Ontario standards for caregiver and personal support records.
Important — when the service recipient is not the purchaser:
If you are purchasing in-home care for a household member (such as a parent),
we will also obtain that person's direct consent before beginning services.
Where the recipient has reduced decision-making capacity, we will work with
the legal substitute decision-maker (such as a person holding Power of
Attorney for Personal Care).
Your consent: By purchasing an In-Home Care service, you
consent to Careby coordinating in-home care for yourself or your designated
household member, to information being shared with assigned caregivers and
monitoring providers as needed, and to family member notifications only with
your prior authorization.
4. Personal Care (Weight Loss & Other Programs)
Applies to: Weight loss (including GLP-1 medications), erectile
dysfunction, hair loss, menopause and hormone replacement therapy,
prescription skincare, and mental health support programs.
What we collect at Careby
- Your name, contact information, and the program you have enrolled in
- Payment information (processed by Stripe)
Careby does not hold your clinical information for Personal Care
programs. Your intake questionnaire, medical history, prescription,
and clinical follow-ups are held by the licensed physician network that
prescribes your treatment and the pharmacy that fulfills it.
Who you will share information with
- A licensed physician from Careby's prescribing partner network, who reviews your intake and prescribes treatment
- A licensed pharmacy, which fulfills any prescriptions issued
How long we keep it
Careby retains your enrollment records (name, program, contact) for 7 years
after the program ends. Your clinical and prescription records are retained
by the physician network and pharmacy in accordance with their professional
obligations.
Your consent: By purchasing a Personal Care program, you
consent to Careby enrolling you in the program and connecting you with a
licensed prescribing physician and pharmacy. You understand that Careby holds
your enrollment and contact information only, and that your clinical
information is held directly by the prescribing physician and pharmacy.
Your rights under PHIPA
For any of the services above, you have the right to:
- Access your records held by Careby. We will respond within 30 days.
- Correct inaccurate information in your records.
- Withdraw consent at any time, by contacting hello@getcareby.ca. Withdrawal applies to future use; some records may need to be retained where required by law.
- Complain to the Information and Privacy Commissioner of Ontario if you believe your privacy rights have been violated. You can reach the IPC at ipc.on.ca or 1-800-387-0073.
